| Affordable housing projects payed attention to the development of the city,at the same time,it payed more and more attention to fairness,especially on the housing problem of urban low-income.Therefore,since2005,our country issued a series of legal documents related to affordable housing.A lot of low-rented housing,economy applicable room was built up.The shanty towns was promoted.However,because of the lack of attention to the overall development and the ignorance of the guidance of town and country planning,problem such as affordable housing planning is not reasonable,the construction is remote appears almost at the same time,which lead to the secondary unemployment and the poverty of low-income people.As the first country of industrialization and urbanization,the town and country planning of the United Kingdom originated in the health improvement to the low-income’s housing,the affordable housing development was accompanied by the different impact of town and country planning concepts and guidance in every different time and period.The legal system of affordable housing lay emphasis on the overall planning.The feature of legal system of affordable housing made up for the deficiency of our country.Therefore,this article tries to comb from the process of the town and country planning adjustment and the influence to the affordable housing in different periods in the history,to summarizes the characteristics of the legal system of affordable housing under the view of town and country planning,to analysis the causes of the changes,and to summarize the experience which is suitable for our country for reference,to put forward suggestions for the development of legal system of affordable housing in our country in the future,to promote the fully development of the legal system of affordable housing.The full text is divided into four parts:The first part focuses on combing the history of the legal system of thehousing under the view of town and country planning.Combing from the perspective of history of the UK,to analyze the relationship between town and country planning.From the angle of the influences of town and country planning,the development of affordable housing law can be divided into three stages:partial adjustments period,fully adjustments period and further adjustments period from town and country planning.Through the different analysis to different characteristics and contents of the different stages of affordable housing development,in order to grasp the different characteristics and the rule of law.The second part focuses on summarizing characteristics of the legal system of housing under the view of town and country planning.It has four characteristics : the guidance of housing under the control planning,the construction of housing under the functions zoning,the clearity of duty and right to the housing mode of the government,the public participation through the whole process.The third part analysis the cause of changes of Housing legal system.Mainly include:the changes different party policy,the development of democratic politics,The influence of ideological trend of law and the inheritance of the tradition of law in the UK.The fourth part focuses on the inspiration of the Housing legal system experience in the UK with the View of Town and Country Planning.This paper first analyzes the existing problem in China’s current legal system of the housing,include:The unbalance of social housing legal system,discordant between the location of social houses and urban functions,the unclear government’s power and duty in housing development,the Urban residential differentiation in housing.To learn from the experience of the construction of UK legal system,I put forward several advises to improve the law in China : Establish housing legal system balance,persistence in the guidance from planning to the development of housing,clarification the government’s power and dutyreinforcement of public participate supervision.The last part is the conclusion,summarizes the core idea of this paper. |
