Research On The Guardianship System Of The Elderly

With the aging population of the world, as one of the most effective way to protect the rights and interests of the elderly ,the elderly guardianship system in foreign countries have been a high degree of concerned in the past two decades. However, China hasn't systematically established a guardianship system for the elderly yet, the legal provisions clearly reflected in 2012. The study on the elderly guardianship system is also a lack of domestic. From the scholars' literature, the related research has gradually increased since 2005, but as so far, there are less than 5 monographs on the guardianship system of the elderly, and most of the domestic research has been discussed about the perspective of comparative law. I'm try to discuss the construction of the guardianship system from the perspective of the construction of our country's guardianship system, combined with the legislative experience, hope be able to make a little effort to further study.This article is divided into four chapters, the first chapter is outlined,breaking the outline of the elderly guardianship system of connotation and extension and history, limited the space, the main purpose is not detailed proof of the guardianship system of the theoretical issues, but for the following argument to based on. Chapter two summarizes and reviews. The third chapter summarizes and reviews the classification of foreign legislation,and the fourth chapter is based on the above chapters, try to build a legislative system, research on the subject of the system, the object, content,procedures and relief,and some other aspects of the author's ideas.
