| Compared with other countries,our country’s administrative power has the characteristics of free discretion,universality and mandatory,which is the most prone to the phenomenon of administrative abuse of power,corruption,abuse of administrative relative person or damage to the public interest.At this stage,the abuse of administrative power is reflected in the administrative examination and approval,and the interference of micro economic activities and local protectionism.To restrict and supervise the exercise of administrative power,to prevent the abuse of administrative power,we should adopt comprehensive strategy,combine the reform of administrative power system,from the administrative power,social power,strengthen the administrative legal system construction,strengthen the supervision mechanism,and ultimately to regulate the operation,power and power and the unity of power and other aspects of reform.The abuse of power as the court to revoke the sued specific administrative act of reason and abuse of administrative power is more academic attention.However,our country’s legislation does not make a clear definition of the connotation of the abuse of power,and the phenomenon of administrative abuse of power is very complicated,which has not yet reached a consensus on the understanding of abuse of power.This situation in a certain extent affected the effective control of abuse of power.In real life,the abuse of discretion in administrative activities is widespread,and the judicial power of the abuse of administrative discretion is weak.In this article,we analyze the meaning,nature,form and reason of the abuse of power. |
