Research Of The Swedish Parliamentary Ombudsman System

Montesquieu who is a famous jurists once said in "The spirit of law","It is a unchangeable experience for all powerful people to abuse their power. People who have power use it until there is a limit." The most effective way to prevent the abuse of power is to restrict power with power. Since the 20th century, along with the growth of the scale of government affairs and the development of administrative centralization, the administrative organs have obtained the discretionary power, administrative legislation and jurisdiction. The rapid expansion of administrative power is in an uncontrollable momentum, which has become a common phenomenon in countries around the world at present. Because of administrative power penetrates into every aspect of social life in the country, and it has most closely related to citizens and legal persons.In addition to its own discretionary power and enforcement of state compulsory force, making it to be a most illegal and abusive power. Therefore, strengthening administrative supervision and restricting administrative power is a common concern of all countries,and it is also an important research area for Chinese and foreign scholars. West European mini-state country Sweden, because of the world ranking is leading year by year in Transparency International's Corruption Perception Index, which has become an object to study for national politicians and scholars. In addition to the basic political system of right of third division; the parliamentary ombudsman system is imitated by many countries and regions in, as pioneered by Sweden,and plays a key role in eliminating corruption,avoiding improper and illegal activities of state organs and their staff, protecting the legitimate rights and interests of citizens and promoting the benign operation of the political system. The paper carries on the analysis research to the Swedish parliamentary ombudsman system origin and evolution, the role of the ombudsman traits and executing mode, supervision object and intervention and working mode by four fields: vicissitude,subject, object, case and etc. Among them,through the method of case analysis, this paper expounds the reasons of intervention and the working model of parliamentary ombudsman,and that is the focus and innovation of this paper. The author hopes to achieve the writing goal of the article, which is to explore the mystery of the efficient operation of the Swedish parliamentary ombudsman system. In order to make up for the defects such as the independence, authority and lack of mobilization of the supervision system in our country, we can repair the loopholes, further improve and perfect it, and provide new ideas and methods. We should make contribution to adapting to the needs of the socialist market economy, the construction of democratic politics and the great rejuvenation of the Chinese nation.
