The number of drug has a very important role in the criminalization and sentencing of drug offenses.Under the condition of drug varieties and drug content is consistent,the more the number of drug,the greater the harmful to the society.Judging by the current state of drug use in China,the regulation of drug quantity is mainly concentrated in several meeting minutes,the criminal law of the People's Republic of China and judicial interpretation have few provisions.From the judgment we study in this article can find that the cases involved in drug-related crimes are complex.There are many problems in the current identification of drugs in China.Firstly,the basis for the number of drugs is incomplete,partly delayed and too simple,and no rules have been made on some of the more contentious issues.Secondly,there is no identification standard of homogeneity,which is not to count the amount of drugs in terms of content.This is an easy way to do justice,but it tends to make the drug count inaccurate and affect sentencing.Thirdly,there are many problems with the specific identification of the number of drugs.For example,the number of drugs that are being seduced by the mood is considered unreasonable;the quantity of drugs is inaccurate when the object is not seized;The existence of these problems makes the current number of drugs in China unstandardized,and the same case has different rulings.This article believes that these problems can be addressed in the following ways.Firstly,we need to improve the basis of the number of drugs.We should improve the foresight of the legislation,and form a concrete and comprehensive basis for the number of drugs.Secondly,we should adopt the standard of homogeneity,and gradually realize the quantity of drugs.This requires us to achieve comprehensive drug identification in the context of technical and economic conditions.Thirdly,we should improve the concrete methods for the identification of drug quantities.In the case of seduction,the number of drugs is determined in different circumstances.We should be able to bring the number of drugs seized to the number of crimes that have been seized with the opportunit,but the number of drugs seized under the temptation of seduction should not be accounted for.We should further regulate the identification of the amount of drugs that have not been seized.In addition,we should also make clear the standards of drug trafficking and use them in the identification of the number of drugs.
