Research On Protection Of Prc Consumers’ Rights And Interests Relevant To E-commerce

With the popularization of computer and the development of network technology,e-commerce has a great impact on people’s life.This new way of trading brings consumers a new shopping experience that consumers are able to obtain goods and services with a better price at home.With the access to the network,e-commerce can effectively break the constraints of time and space,effectively improve the transaction speed,reduce transaction costs.Although the development of e-commerce is a trend which cannot be halted,we also need to pay attention to the impact of Electronic Commerce on the traditional consumer rights protection system.In the event that the consumers are in the passive positions in the e-commerce environment,and the infringement of consumers’ rights and interests through e-commerce is likely to be more serious than in traditional transactions,and loss prevention and compensation system fail to be operated effectively,therefore,it’s essential for us to resolve the problem and to improve the system of protection of rights and interests.It is regrettable that,although e-commerce laws have been greatly developed in the past twenty years,such as Consumer Protection Law,Electronic Commerce Act(Draft),our country’s laws or regulations for consumer rights in e-commerce have still not been perfect.Electronic Commerce Act(Draft)has already adjusted and improved rights and interests protection in electronic commerce,but it is undeniable,promulgation of "electronic commerce law" needs time,the legal system of electronic commerce in China is not sound,in reality there are too many frequent occurrence of infringement.In the face of infringement,most consumers chose to give up claiming due to all kinds of difficulties.This article is based on the research of electronic commerce and consumer related theory,the electricity supplier infringement cases,analyzes the causes of problems and to protect the interests of consumers in e-commerce environment,on the basis of the experience of overseas e-commerce consumer protection legislation,proposed the establishment of a sound regulatory mechanism and comprehensive e-commerce consumer e-commerce dispute settlemen mechanism improve the protection of electronic commerce consumer rights in China and suggestions.This article provides some practical advice on how to improve the domestic consumer protection system in e-commerce,such as extending and innovating the system,for improving the rights and interests of consumers,improving the return system without reason,protection of consumers’ right to know,the consumers privacy protection and so on.
