Network lending is a combination of Internet technology and lending in recent years.It is a more typical financial innovation.This rapid development of innovation in China mainly attributes to the government to promote the development of Inclusive Finance,improve the financial regulatory coordination mechanism,so that small businesses can have the development of space and platform to make more people become the beneficiaries of Inclusive Finance.In fact,the past few years there are many companies and individuals through the P2 P platform for investment and financing,to achieve their goals.P2 P help to help small businesses to solve the difficulties of financing,to meet the personal financial needs,while improving the utilization of idle funds,there is a great value.However,because P2 P network loan is an exotic,it is difficult to achieve the development of China's actual situation in a short time,the beginning of the development of chaos,there is no uniform and clear regulatory measures,resulting in some people opportunistic,even took the opportunity to illegal fund-raising.P2 P platform daily surge,the problem platform is also endless,many innocent lenders became victims.Due to the imperfection of the regulatory mechanism,the network lending can not play its own value,but undermine the healthy development and operation of the financial market.After discussion by many scholars in the financial and legal circles,and the discussion of the community,August 2016 formally adopted the Internet lending information intermediary business activities management Interim Measures,the end of the network borrowing chaotic situation,but the rationality and feasibility of the core provisions of this interim approach remain to be elucidated.Part of the regulatory mechanism remains to be improved,there is still the value of research.This paper is divided into four parts.The first part introduces the case of the most serious penalty in the field of network borrowing.Through the analysis of the legal problems in the case,it reflects the current situation of the current network lending and the necessity of regulation.The second part analyzes This paper summarizes the current and legal basis of the network loan supervision in China,and analyzes the shortcomings of these regulatory documents and measures.The third part analyzes the relationship between the UK and the United States as the The fourth part points out that these regulatory measures can not take into account the network lending,combined with the loopholes in the previous analysis and the lessons learned from the outside world to improve the quality of the network lending,and it is worthy of our reference.Suggestions and implementation recommendations.
