The Research On Sino-US “337 Investigation” Trade Friction

Since establishing the Sino-US diplomatic relationship in 1997,bilateral trade has experienced a sharp growth,but at the same time,trade friction was never stopped,the structure of products which China exports to US has upgraded gradually,the “337Investigation” is edging out “Two against Two Guarantee” measures and becoming the main measure of trade friction between China and US.According to this phenomenon,this paper researches “337 Investigation” from four aspects based on previous studies.Firstly,I summarized the “337 Investigation” System from the origin,investigating process and relief measures.Then I analyzed the current situation of US led “337 Investigation” against China getting the following conclusions: China is the main investigation country,the main cause of action is patent infringement,the ratio of lawsuit losses is very high,mechanical and electrical products are the main investigation objects.Secondly,researching on the reasons for the US led “337 Investigation” against China from two aspects,macroscopic and microcosmic,concludes that the macroscopic reasons are: the US needs to protect intellectual property,the patent competitiveness of Chinese export products is low and American trade protectionism has become popular;Microcosmic reasons are: the enterprises respond negatively,enterprises lack independent intellectual property and the sense of intellectual property,the characteristics of the “337 Investigation” are the reason for the investigation.In addition,this paper analyzes and summarizes some experiences from the classical case of the Chinese company,which responded to the Japanese company successfully.Furthermore,having used the PCA method to analyze the US led “337Investigation” against China landed me to the conclusion that the main reason for the investigation is trade protectionismlastly,coming up with some strategies to figure out the “337 Investigation” for both private enterprises and the government.These strategies being: Private enterprises need to promote independent innovation ability,carry out market diversification strategies and register patents in the US actively so that Chinese companies can get the opportunity to exchange the intellectual property withAmerican companies;The government needs to carry out intellectual property strategies and try to establish Chinese “337 Investigation” terms.
