Excluded liability in an insurance contract is the extent to which the insurer is not liable according to law or contract.The insurance clause is required to provide insurance liability,but also to provide excluded liability.In addition to war,natural disasters and other uncontrollable factors,the international act makes the insurance company exempt from liability.Insurance and risk occur simultaneously,and the occurrence of a dangerous event promotes the need for insurance.Risk in insurance law refers to unpredictable or force majeure.With the rapid development of economy,insurance has become an indispensable part of the national economy.Meanwhile,insurance fraud is rampant,which seriously hampered the development of insurance industry.Insurance fraud has been identified as the current greatest part of the threat.(1)And therefore the crime of insurance fraud has also been widely concerned.Excluded liability clause in insurance contract can make the insurance company exempt from liability when the fraudulent acts happened.The crime of insurance fraud is also intended to combat the infringement of insurance company property.To some extent,the purpose is consistent.Therefore,the purpose of this paper is to explore whether to prevent the insurance fraud and punish fraud by the improvement of the excluded liability clause,then achieve light punishment.
