On The Construction Of China Maritime Ad Hoc Arbitration System

In the field of international maritime arbitration,ad hoc arbitration is a general system.Relative to institutional arbitration,its superiority is rather obvious.However,China's legislation has not yet universally recognized the ad hoc arbitration system,especially in the maritime field,which had a very negative impact in China's maritime arbitration cause.At this stage,we should catch hold of the opportunity that maritime arbitration is developing ad hoc arbitration,learn from the international advanced experience,and explore actively to build a ad hoc arbitration system in China.This thesis is divided into three parts:The first part is:The absence of China's maritime ad hoc arbitration system.In this part,the author starts with analyzing the status quo of maritime arbitration development in China,then dissects the causes of this situation,and finally discusses the shortcomings of the absence of maritime ad hoc arbitration.The second part is:The ad hoc arbitration of in LMAA arbitration system.This part systematically studies the whole system of arbitration of LMAA(London Maritime Arbitrators Association)from the aspects of theory,legislation and practice,and highlights the advanced nature of maritime ad hoc arbitration system,so as to provide reference for the construction of China's maritime ad hoc arbitration system.The third part is:The analysis of construction of China's maritime ad hoc arbitration system.After analyzing the obstacles of constructing the maritime ad hoc arbitration system in China,it is found that the introduction of ad hoc arbitration in the maritime field is feasible,and then the author provides a concrete idea for the construction of the maritime ad hoc arbitration system.
