Network Accessory Research

Network accessory who provides assistance to the network crime,as a form of crime in cyberspace,is different from the general help offender.In cyberspace,on one hand,the connection and interaction between the accessory and the principal offender are obviously weakened so as to add difficulties to the conviction for joint crime.On the other hand,a lot of accessories’ role of joint crime has been significantly improved.It will inevitably violate the principle of suiting punishment to crime if the accessory is still punished in accordance with the provisions of the help offender.Based on this,this article is intended to amend the original theory of joint crime,in order to achieve a reasonable conviction and sentencing on network accessory.The first chapter of this paper is to introduce the concept of network accessory and its premise."Network to help offenders" from the structural point of view is divided into "network" and "help offenders" two parts,such as the network to help criminals to make a correct understanding,should first behind the "cybercrime","help offenders" Concept to make a correct understanding.Therefore,this article through this chapter of the "cybercrime","network common crime","help offenders","network accessory" and other concepts introduced.The second chapter of this paper discusses the new features that help offenders in cyberspace,and these features can not or can be reasonably explained by the current theory of accomplice.In the third chapter,the author puts forward the method of identifying the network to help the crime,that is,the establishment of the network to help the establishment of the conditions and recognition of one-sided help offenders,aimed at solving the network to help convicted crime.In the fourth chapter,the author puts forward the method of making a reasonable sentencing to the network,that is,the attack on some network help.
