For peace and security of people that terrorism crime is a "time bomb".It’s a great threat for national security,social order,personal and property safety.Any countries are unavoidable to face the terrorism crimes.Therefore,fighting against the terrorism crimes will be a long-term and arduous task for the international community.Now faced with the severe terrorism crimes situation,all countries in the world are stepping up their efforts,have passed legislation to regulate the terrorism crimes.They were not only stipulated the anti-terrorism substantive laws,but also added the special criminal procedure of terrorism crimes that different from the ordinary criminal procedure.Compared with the countries that the degree of domocracy is relatively mature,the anti-terrorism law system of our country is still lag behind in them.At present,in addition to some anti-terrorism substantive laws,anti-terrorism international treaties and some relevant anti-terrorism legal documents,and there is no a set of the special criminal procedure of terrorism crimes that can really against the terrorism crimes in our country.Besides,though our country promulgated The Anti-terrorism law of the People’s Republic of China in 2015,its content cannot cover all the anti-terrorism laws,and prefer to administrative law.Therefore,It is imperative to build the special criminal procedure of terrorism crimes in China.The special criminal procedure of terrorism crimes is to meet the needs of the anti-terrorism that pass the procedure legislation to regulate the terrorism crimes.It is not only the procedural safeguards,but also an indispensable part of the anti-terrorism law system to fight against terrorism crimes.Except preface and conclusion,there are four parts in this essay.The first part that describing the characteristics of the terrorism crimes,which different from ordinary criminal.The second part expounds that it’s necessary and feasible to construct the special criminal procedure of terrorism crimes in our country.Due to the particularity of terrorism crimes and our country’s ordinary criminal procedure cannot meet the needs of the anti-terrorism,so it is necessary to build the special criminal procedure of terrorism crimes.What’s more,Due to the experience summary of the fight against terrorism crimes in China in recent years,the strengthening of international anti-terrorism cooperation and exchange,and the continuously exploring of the theoretical research on anti-terrorism,so it’s feasible to build the special criminal procedure of terrorism crimes in our country.The third part that comparing the special criminal procedure of anti-terrorism of the United States,Britain,France and Russia,and summarizing the similarities and differences among them,which as reference for our country to build the special criminal procedure of terrorism crimes.The fourth part expounds that our country should choose the procedure legislative mode,and adhere to the four basic principles,including the rule of law,the protecting human rights,the equality and the appropriateness.Finally,proposing the concrete design for build the special criminal procedure of terrorism crimes in China.
