Folk literature works and fine arts is the unique culture originally created by the social tribes or related nationalities,and it is also the critical cultural heritage of a country.It belongs to the nationality,the country,and the entire world.In the sense of strategic importance,folk literature works and fine arts is the foundation and “living fossil” of the culture’s existence,which can maintain folk culture,promote the reserve and development of related tribes’ spiritual culture.With the accelerated development of globalization,industrialization and information,and the ascendant process of cloud calculation and big data,people’s thoughts have been changed.The usage of folk culture lacks original essence and economy-related respect most of the time,but the change and revolution we talk above accelerates this trend.To seek exorbitant profits,folk cultures and fine arts has been over commercially developed in a large scale by some people.Meanwhile,numerous infringers lack respect of protecting and transferring the folk culture groups.They do not bring back goodness to folklore,on the contrary,they harm the cultural spirit badly.For example,an absurd commercial use of folk culture,the free adaptations of the fine arts,and even the plagiarism is made or used by this kind of people.This makes our folk culture and fine arts faced with severe inappropriate usage,even distortion and damage.Be faced with this horrible fact,we should put the protection agenda on top of our priority,which includes doing research and coming up with the solution of the copyright protection problems.Forming a common sense to deal with this problem,we will let the folk cultures and arts serve the socialist culture and economic development in a better way.The present paper plans to discuss the concept of folk culture and fine arts,the current situation and weakness of copyright protection,and analysis the legal relation construction of copyright protection.This paper aims to call on the construction of the framework of legislation,promotes the protection strength,diversify the contents of protection framework which contains special copyright features,and come up with related suggestion and path which is operable and practical.The present paper contains six parts.The first part is introduction.It displays the background,domestic and overseas current situation and the way to research.The second part discusses the related basic concept of folk culture and fine arts,which includes the concepts and features,appreciation of related works,and the category.The third part discusses the current situation and weakness of folk works protection.To seek the basic protecting orientation by researching the malpractice of domestic and overseas folk works protection legislation practice.The fourth part is the research of the legislation construction of the folk works and fine arts.This paper will display the legal system via subject,object and contents.The fifth part analysis the Inheritance,development and commercial usage of folk works and fine arts,and then come up with advice and suggestion.
