Research On Construction Of Catastrophe Insurance Legal System In China

The occurrence of the Wenchuan earthquake in 2008 attracted people’s and government’s attention on the catastrophe insurance.The Third Plenary Session of the 18th CPC Central Committee proposed the decision to establish a catastrophe insurance system.Many places,such as Shenzhen,Ningbo,Chuxiong,Sichuan,have carried out catastrophe insurance pilot.As a consequence of the malfunction of catastrophe insurance market,the character of catastrophe insurance is non-profit.The insurance is a kind of policy property insurance.The legal relationship of catastrophe insurance contains diverse legal relationships between many subjects,like the insured and the insurer,the original insurer and the reinsurer,the insured and the insurer.At present,there are different kinds of catastrophe insurances on the aspect of earthquake,flood,typhoon and others.The analyses of current catastrophe insurance revealed many problems that hindered the construction of the system.The regulations are basically principles and contents are not specific.The status of the government is not clearly set.Therefore,it is an effective way to bulid China’s catastrophe insurance legal system through elaborating the contents and specify the government’s status and etc.
