Workers are an important group of society,senior management personnel from the social status,their image and profitability are higher than ordinary labor.In recent years,more and more senior management personnel labor dispute cases.Especially large enterprises in China in all kinds of disputes emerge in an endless stream labor relations caused by the executives,one of the main reasons from the development of China’s "labor law" for the executive behavior norms and constraints is vague,and even the nature of high tube personnel and are not right the exact description of the many by executives of labor relations is not clear due to legal disputes in the enterprise,which not only affect the normal operation of the company,or even bring serious economic impact.Therefore,we should pay more attention to such issues,focus on the analysis of senior management personnel in the community as well as enterprises in the accurate positioning and division of labor,including positioning,position,compensation and other research is very necessary.In this article,through the analysis of typical cases,summed up the executives in the process of leaving,the more common three problems,and its theoretical analysis.From the company’s senior executives qualification,three aspects of appointment and compensation,referring to foreign legal resources,in the case of the "executive" represents a class has a dual identity attribute in labor law on the status of the main line,combined with the actual situation of different views of the senior management personnel in the company a series of observation and discussion,different positioning and focus on the legal status of the senior management personnel in the company,and the relationship between law and company,and the compensation problem after discussed.The company executives should be classified as judge,in the case of executives Xu,this kind of all his time and energy into the company’s operations on company executives,should determine which is more "employees" in nature,its essence is consistent with the labor law in the status of "laborers",so this kind of executives in the labor relations lift,should enjoy various rights of workers should have,and get reasonable compensation.The end is the summary of the full text.
