The Research On The Government Regulation Of Solid Waste Dumping In Different Places In China

In recent years,the solid waste were dumped in different places often appeared in China,chromium residue pollution incident occurred in Yunnan province in 2007,39 tons of mercury containing waste were illegally dumped in Luoning of Henan in 2016,Shanghai dumped nearly 4,000 tons of garbage to Suzhou Taihu Lake in 2016.Every year a large amount of solid waste was not included in the environmental protection department statistics scope,and escaped from the government regulation.Dumped solid waste had become an important source of water and land pollution in some areas.This kind of "benefit oneself at others' expense" environmental pollution was causing serious threat to the ecological environment,putting great pressure on the environmental protection work,violating the social green development concept of our country and influencing the overall layout of the government's strategy.This article starts from the theoretical basis and realistic necessity of government regulation of dumping solid waste,and then expounds the existing legal system of central co-ordination,local implementation of the regulatory system,structured,classified regulation,wide range of content,and a variety of market-oriented means of regulation.These measures can effectively regulate the orderly transfer and disposal of solid wastes to a certain extent,but dumping solid waste events are still occurring continuously,reflecting that government regulation system,regulating the law and regulating means exist some problems.These events are different in time,criminal means,legal relations and involved responsibilities,and measures taken by the government,but the common point is that the government can not effectively curb the company's economic interests,making the situation that "the cost of law enforcement is high,but the legal cost is low".Through the game analysis of the government and the inter-firm behavior,this article concludes that the government should increase the punishment of the stolen enterprises and should tend to pre-supervise the conclusion.At the same time,based on the experience of the United States' operate the licensing system and tracking system,Japan's subpoena system,German track the single system as the core of the government for solid waste transfer process regulation on the basis of experience.Our country can strengthen the cross-regional intergovernmental cooperation,establish departmental linkage mechanism to strengthen the joint defense control;add the general process of solid waste management of the entire law,the punishment based on the comprehensive dumping and pollution levels,establish corporate pollution accident liability system to improve laws and regulations;implement environmental impact assessment system,"three simultaneous"system,increase the positive and negative incentives for enterprise registration,accelerate the establishment of the national solid waste management information system,promote information disclosure,use new media to enhance public participation to perfect supporting system.These measures can effectively regulate China's solid waste transfer cross-border,contain the dumping of different places,and promote the implementation of China's social green concept in place.
