Analysis On Chinese Film Censorship System From The Aspect Of Law

It is more than a hundred years since the release of the first film. As newspaper and broadcasting, film should be protected legally. In our legal context, film censorship is a typical administrative license. Due to the influence of people’s morals and values,supervision and censorship of films are essentially important. Immoral contents (such as violence, sex, drugs) may have bad influences on normal life even may give rise to social turbulence. As a result, film censorship is a must. However, the management of governments has limits. It cannot limit individuals’ freedom of expression or violate private property rights.With the development of the market economy, Chinese Film Censorship can not meet the needs of the film industrialization. Film censorship system has a great many problems in the aspect of subject, standard, procedure and remedy procedure. In the aspect of subject,the government doesn’t meet its obligations well. Firstly,it is difficult to enter the film industry. Secondly, the film industry is deficient in money. Thirdly, the film industry lacks public service. In the aspect of standard, there are three problems:some of the standards are illegal,some of the standards are not reasonable,some of the standards are fuzzy. In the aspect of procedure, there are two problems. First, the review process is not open. Secondly, the procedure lacks reasoning system, voting system,hearing and secret ballot system. Lastly, the remedy procedure is imperfect. Therefore,the reform of film censorship system has been the focus of legal academic area andartistic genre for a very long time.How to reform China’s film censorship? There are no conclusions so far. In the modern world, there are three main kinds of censorship mode: American mode, English mode and Chinese mode. The text introduces the film censorship of America and UK from which we find the wide use and pros of film classification and analyzes the feasibility of introducing film-rating system in China.In the last part, the paper puts forward solutions to solve problems in aspects of subject,standard, procedure and remedy procedure. In the aspect of subject, three measures can be taken. Firstly, the government should make it easier to enter the film industry;secondly, the government should imply the fiscal, financial and tax support policy;thirdly, public service of movie should be strengthen. In the aspect of standard, the government should perfect the system of laws and regulations, delete the unreasonable censorship standards and clear the review standards. In the aspect of procedure, the publicity of the reviewing procedure arid the establishment of the voting system, hearing and secret ballot system should be paid attention to. Besides, the remedy procedure and the movie review files should be perfected. All these measures will help perfect our country’s film censorship and promote the development of film industry.
