A Married Person With Same-sex Cohabitation Legal Issues

In recent years,the marital status of the homosexual group has received more and more attention.According to estimates,the number of gay people in China has exceeded 70 million people,the same wife number has reached 46 million people,while the same husband number has reached to more than 10 million people.As the particularity of homosexual marriage,"the same wife" and "husband" are faced with the lack of family warmth,domestic violence,infectious disease threats and many other issues to be solved.At present,China does not have a spouse with same-sex cohabitation and other conditions to make relevant laws and regulations,so they are more difficult to protect the rights,even worse.There has great significance of concerned about their rights and interests,for the maintenance of social fairness,equality.This paper aims to promote "the person who has a spouse and same-sex cohabitation" and "the person who has a spouse and heterosexual cohabiting" in the legal sense of equivalence,protection of the opposite sex without fault in the legitimate rights and interests of one party,and for compensation for mental damage.Only in this way can we truly achieve social equity and justice,protect the legitimate rights and interests of vulnerable groups.This paper aims to study the living conditions of the population,by using the system analysis,literature analysis and case analysis,research methods,and seek reasonable experience,explore the protection "with his wife","husband" legitimate rights and interests and national conditions consistent with the legal system.This thesis consists of three parts: introduction,main body and conclusion:The introduction part introduces the historical evolution of the relationship between the third,second,forty-sixth in the "marriage law",the concept of the relationship between the damage of the marriage,the concept of the dispute,the significance of the topic and the purpose of this paper.The introduction part introduces the historical evolution of the relationship between the third,second,forty-sixth in the "marriage law",the concept of the relationship between the damage of the marriage,the concept of the dispute,the significance of the topic and the purpose of this paper.The first chapter,through the examples,he and Yang,Xu case dragon case,leads to the focus of such cases exist.In the second chapter,the legal theoretical analysis of the legal nature,legal consequences,and spiritual compensation of the spouses and the homosexual cohabitation is carried out.The third chapter,combined with the examples of the first chapter,the second chapter according to the analysis of legal theory,the specific application in the practice of law.The conclusion summarizes the whole thesis.
