Research On Government Roles In Personal Information Protection

Along with the rapid development of information technology and Internet,the security situation of personal information(PI)is increasingly severe in China.The insecurity of PI not only affects people's daily life seriously,but also has a serious impact on national security and social stability.In fact,many incidents indicate that personal information protection(PIP)has become a social challenge for the government,and it need to be addressed appropriately.In the process of marketization,the government has did some efforts to strengthen the protection of PI,but the security situation of PI in China is still very serious,which shows the government roles in PIP have not been played fully and effectively.Therefore,this study,based on the perspective of government,takes PIP as a social public problem,and emphatically analyzes the status quo and existing problems of government roles in PIP,and their influencing factors.Then,this study intends to explore how the government to exercise its functions precisely in order to strengthen the protection of PI.At present,the government has played some important roles in constructing laws and regulations related to PIP,regulating the behavior of collecting and using PI in the market,combating criminal acts of violating PI,and guiding social organizations' participation in PIP.However,it shows that it's governance mode and actual effect are not sufficient which reflected from the binding of relevant laws and regulations,the effectiveness of market regulation,the way of governance,and the participation of social organizations.As for reasons,these problems are mainly result from the government's characteristic of economic man,the imperfection of related functional system,and the absence of other social subjects in PIP and so on.Based on the analysis of problems of government roles in PIP and their reasons,this study suggests that the government should enhance government's response capacity in PIP and strengthen pertinence of policies for PIP through basic countermeasures,system construction and safeguard mechanism,etc.so as to improve the government's performance in PIP.
