On Legal Regulation Of Lottery In The Internet Age In China

The sales of lottery has increased from one hundred million to over eighty billion in ten years from 2005 to 2014 with the application of the internet technology on the lottery. According to the statistics, the sales of internet lottery has accounted for 20.9% of the sales of lottery in 2014. There is no doubt that internet lottery will play an important role in lottery sales in the future. But the internet lottery isn't always going right in China, the supervisory department has halt internet lottery several times due to it's short history and the lack of relevant legal system. By summarizing the development process of lottery, generalizing the irregularities of lottery in the internet age, analyzing the deep-level reasons why the government ban internet lottery, this paper tries to arouse our reflection on market access system, issuance and sales system, public welfare fund management and distribution system and supervisory system of lottery.This paper starts with internet lottery, by applying the methods of comparative analysis, analytic induction and cross-disciplinary research, gives rise to thinking of the legal system of lottery. It's necessary to point out that internet lottery is one of the sales modes of lottery, and the analysis of it's existing problem is to arouse thinking of the legal system of lottery. Firstly I come up with the existing problem of the internet lottery, then analyze the deep-level reasons of these phenomenona, in the end I come up with a solution by combining China's actual conditions with experience of developed countries. This paper is divided into the following parts: The first part gives a general description of the development of lottery, from traditional paper lottery to internet lottery. The second part gives a detailed analysis on the subjects of the legal relationship of the internet lottery and their rights and obligations in the sales contract and agency contract. The third part points out the irregularities and the reason why these phenomenona occurred. The last part introduces advanced experience of other countries, and on basis of that, I come up with improved solution for various systems mentioned above.
