This paper mainly studies the deep-linking in indirect infringement of right to network dissemination of information.Actually, deep-linking is not a legal term, it is originally derived from computer technology. In recent years, with the rapid development of the Internet, lots of Internet-related disputes arise. "deep-linking" as a non-legal term often emerges in the judicial trial,and the deep-linking-related problems causes a great discussion of practitioners and academics, which includes the definition of deep-linking, the behavior property of deep-linking and the constitutive requirements of deep-linking in indirect infringement.These problems are necessary to have a deeper research in terms of academic. In addition, the number of deep-linking-related disputes on copyright increases year by year, a unified standard to judge the infringement of deep-linking is important and urgent. Therefore, the study on copyright infringement of deep-linking not only has important academic value but also has practical value.Besides preface and epilogue, this paper is divided into four parts:The first part is the definition of deep-linking. Since the deep-linking is not a legal term,the definition of deep-linking is not unified in practitioners and academics. This paper argues that deep-linking comes from the development of network technology, its definition should also return to information technology. In this paper, it is divided deep-linking into two categories which have legal value by its different expression: deep-linking outside the chin and deep-linking within the chin, so that the Infringement can be typed discussions.The second part researches the behavioral properties of deep-linking. As the emphasis of this paper, there has three different standard from jurisprudence and legislation of domestic and foreign: user standard, severe standard and alternative essence standard.This part analyses the pros and cons of those three standards, drawing a conclusion that the standard must return to the law. Meanwhile focus on the Article VIII of "WIPO Copyright Treaty", which is the earliest source of right to network dissemination of information, agreeing deep-linking enlarges the ought-to-be range of the public have access to works is the key to result provide the public with the works. And then respectively discuses deep-linking outside the chin and deep-linking within the chin, resulting that the deep-linking outside the chin cannot constitute a behavior of providing the works, while deep-linking within the chin have possible toconstitute a behavior of providing the works.The third part focuses on the particularity of deep-linking constituting indirect infringement, mainly discusses two aspects:whether indirect infringement should be premised on the existence of direct infringement and the subjective fault of link makers. Through comparing "the subordinate character theory" and "the independent character theory",concluded that the deep-linking related indirect infringement should adapt "the subordinate character theory". In addition,It also focuses on definition of the subjective fault in "clearly know" and "should have known".The fourth part focus on measures of deep-linking infringement, on the one hand through unifying the judgment standard on direct infringement in law, clearing that the indirect infringement should adapt "the subordinate character theory". And through legal and judicial precedents to get uniform standards of the subjective fault so that the law plays a good guide.On the other hand, works to promote the rights of people to set up technical measures to prevent free-riding by third parties, but also to encourage Internet service providers to cooperate in the form of deep-linking works.
