The Legal Rules Of Trade Facilitation In China’s FTAs

Under the regional level, China signed Free Trade Agreements(FTAs) with South Korea and Australia On June 1 2015 and June 17 2015 respectively.These FTAs took take effect on December 20 at the same year. The signed China-Korea FTA and China-Australia FTA represent a higher level development in our country, and will further promote the new development of China’s regional economic integration. At the same time,the trade facilitation rules also reached a new height, e.g., comparing with other signed FTAs, the customs procedures and trade facilitation chapter first absorbed the relevant rules in Agreement on Trade Facilitation(TFA) of World Trade Organization( WTO) and enriched the content of the customs procedures and trade facilitation issues.Under the multilateral level, trade facilitation made breakthrough progress in recent years. In December 2013, WTO members concluded TFA at the Bali Ministerial Conference, as part of a wider “Bali Package” and adopted on 27 November 2014 a Protocol of Amendment to insert the new Agreement into Annex 1A of the WTO Agreement. The TFA will be enforced once two-thirds of WTO members have completed their domestic ratification process. As the first multilateral trade agreement during the past 20 years, TFA is the most important breakthrough since the launch of the Doha round negotiations and will make great significance and far-reaching influence to the world,especially China’s economy. For our country, TFA will speed up the implementation of the release of the goods and flow, improve the trade efficiency, reduce the trade cost,enhance the level of trade facilitation, decrease the product import and export barriers, create favorable conditions for convenient customs clearance and play a positive role of promoting the healthy development of foreign trade in our country.Take this opportunity, this paper aims to study the development of China’s trade facilitation in the FTAs, major measures and characteristics, then adopting comparative analysis method, making a comparison with WTO trade facilitation rules especially the TFA rules,Also making a comparison withtypical American FTAs and European Union FTAs, exploring their revelation to the trade facilitation rules in China’s FTAs, and discusses the problems and thecoping strategies in our country. Specifically,this paper is divided into five chapters.The first chapter is an overview of basic theory on trade facilitation and determine the definition of trade facilitation and its basic elements. On this basis, then explore the development of trade facilitation and its characteristic from the multilateral and regional level respectively to clarify the cause and effect of trade facilitation. Then focuses on the China’s trade facilitation rules of FTAs, mainly through text analysis, study the development, the main measures and its characteristics of the China’s FTAs trade facilitation. e.g., it experienced by simple and complexity, from scattered to special chapter, and then analysis of the main measures, such as through analysis the transparency, customs cooperation and advance ruling rules and so forth.In order to conclude that there are some features about trade facilitation of China’s FTAs,i.e. no model rules, expand the use of good governance provisions and gradually absorb the WTO rules and so forth.The second chapter studies the main content of TFA. As one of the most important achievements at the multilateral level in recent years, got development and change on many of the content on trade facilitation. Further through comparing with the trade facilitation rules of China’s FTAs to explore the differences and the enlightenment for ChinaThe third chapter describes the content of trade facilitation in the United States and the European Union FTAs to have the comparison with the trade facilitation rules of China’s FTAs. The United States and the European Union as the largest economy entity in the world,got leading level in many areas, also the rules of trade facilitation has led the world in many ways.It is necessary to studyUnited States and the European Union’s rules of trade facilitation,so as to reference and develop in our country’s FTAs. The fourth chapter examines the problems of trade facilitation in China’s FTAs,combined with the actual situation of the development of trade facilitation in recent years,the writer regards the trade facilitation in China’s FTAs faced several problems, such as the impact of the TPP,the Spaghetti Bowl Effect and the difficulties in the implementation and so forth.The fifth chapterputs forward some proposalsbased on the trade facilitation problems in China’s FTAs.
