| The system of administrative litigation jurisdiction of concentrated is national courts at all levels of administrative cases over the years have been the focus of the innovation,practical effect is obtained and experience the most substantial part.People’s court in Lishui City of the relative centralized system of designated jurisdiction pilot work has received the widespread attention,the feedback and related the wave caused a discussion of theory and practice.After that,in more spread on a trial basis,has achieved a more comprehensive feedback results.The administrative litigation law in 2014,after modification,the courts at all levels to let go of the hands and feet,generally start within their respective jurisdictions to carry out the system of administrative litigation jurisdiction of concentrated reform work.This article introduced to Shenzhen in June 2015,the concentration reference sample,collecting the related data to carry on the system analysis,to explore the jurisdiction of the centralized system in practice reflects the advantages and existing problems.Through data can be directly found,centralized jurisdiction system can really play a deterrent improper administrative intervention,improve judicial efficiency and professionalism,the rational allocation of judicial resources,and the same referee scale,promoting the value of judicial credibility,etc.But also the existence of insufficient strength of the parties’ legitimate is not perfect,not radical reform and other issues.By deep analysis of the above problems,found that by adjusting the corresponding measures,reduce litigation costs,and ways to build communication mechanism can realize the centralized reasonable jurisdiction centralized jurisdiction should be to establish a special administrative court.Therefore the author further discusses the feasibility of specially structure of the trial function has carried on the preliminary research. |
