| In the modern litigation,the witness appearing in the court to provide testimony is one of the inevitable demands to realize procedure justice and entity justice.However,it is quite normal that the witness does not appear in the tribunal during the procedure in C hina’s criminal proceedings.Although it is caused by many kind subjective and objective reasons,it is mainly due to the lack of rights’ protection of the witness.Therefore,our country began to focus on strengthening the protection of witness in recent years.The Criminal Procedural Law which was modified in 2012 preliminary establishes the witness anonymity system.And the judicial offices over the country carry on the explora tion of it in the meantime.However,the system still has many deficiencies during the development.Considering both the advantages and disadvantages of it,it is quite necessary to pay attention on the balance of different rights during the perfection process.Basing on the above,this thesis focuses on the research of witness anonymity system in C hina.Its analysis depends on both theoretical and practical aspects and it also points out the feasible improvement way of it.Chapter one is an overview of the basic problems related to the witness anonymity system.Starting from the basic concept,and then analyzes its specific ways,features,and properties.Besides it introduces the establishment of the system.Chapter two is the evolution of the witness anonymity system’s value.It includes the positive and negative effects of it,and talks about how to balance the rights of witness and defendant.Chapter three is about the present situation of the system in China.It includes the study of the system on both international and domestic levels,and analyzes the current judicial practice.In the meantime,it points out the existing problems of the system,such as the narrow applicable cases,the limited protection of personal rights and the lack of specific procedures.Chapter four is about the witness anonymity system’s improvement.The thinking perspective covers the expansion of the application scope,the increase protection of property benefits and the specific procedures. |
