The Research About The Government Regulation And Legal Mechanism In The Construction Of E-business Credit System

“Internet+”mode makes the most of internet resources to apply in traditional industries,which makes the industrial cluster more efficiency and creates new eco-economy to upgrade the whole industry.Because of the “Internet+” and “Sharing Economy” modes,the virtual economy in different regions has come true.Economic base determines the superstructure,industrial legislation emerges and develops with the emergence and development of related industry.Since 2014,which is the first year of E-business legislation,after E-business legislation being confirmed,some related laws and regulations such as “Electronic Signature Law” have arrived successively.Meanwhile,the Ninth Criminal Amendment came into effect last year.It specifies the obligation of network operators who punish network security management and the penalty of network crime.Although the construction of E-business legal system still have a long way to go,it can be hopeful with the development of E-business industry.In recent years,the E-business credit legislation can only be found in the Civil and Commercial legal system,but “Electronic Signature Law” and “The Electronic Certification Service Management Approach” are great progresses.Although these laws and regulations set more rules on E-business operation instead of credit problems,the legislation of E-business still worth looking forward to its quality.As one of the main business modes,E-business is not only a revolution of technical platform but also a key link to national economy and national economic system.In some developed regions,such as the United States and European Union,the laws and regulations related to electronic signature,privacy and data have already come out.Meanwhile,their governments pay more attention to credit problems between e-business operators and consumers,then put forward different legislation practice according to different legal interests.Whether our national e-business credit system can be optimized or not leading to the development of both e-business industry and our national economy.In the face of increasingly e-business dishonest events,the government's supervision and guidance play a significant role in improving the mechanism of e-commerce law.So the article has been analyzing the perspective of e-business credit legal system construction,comparing the domestic current situation of government regulation legal system with abroad,then focusing on the realistic path of China's e-commerce integrity legislation and putting forward some suggestions in details in order to contribute to the practice of government regulation legal system in China.
