Research On Criminal Policy Of Bribery Of Crime

China’s current governance over bribery crime is not so ideal and can not adapt to the increasingly complex bribery crime situation.The previous study of bribery crime is mostly on the legislative level,and the punishment of bribery crime is limited to the scope of criminal law while ignoring the fact that the governance of bribery crime is a systematic and comprehensive project,The criminal legislation of bribery crime is only one important aspect.So we need to examine the issue of bribery on the criminal policy level,comprehensively using various methods to control bribery through the guiding function of the criminal policy.This paper introduces the meaning of criminal policy and academic differences,that the criminal policy of bribery should be broadly understood,And then reviews and summarizes the process of criminal policy of bribery crime in China,introduces the main contents of criminal policy of bribery crime in China,including the basic criminal policy of bribery crime and specific criminal policy.What’s more,through the review of governing philosophy,policy implementation,legislative provisions,judicial status and other aspects of bribery management,it points out some problems.The philosophy is obsolete,the legislation is severe but not strict,the judicial is neither severe nor strict.lt profoundly reflects the reason of the present unsatisfying bribery management situation.Finally,the author puts forward the specific idea of revising the criminal policy of bribery crime,and holds the idea that it is necessary to update the criminal policy philosophy of bribery crime,correctly understand and apply the basic criminal policy of tempering justice with mercy in a limited and tolerant attitude,perfect the comprehensive management system and legislation of bribery crime,improve the bribery crime investigation rate in order to establish a scientific and rational bribery criminal policy system so as to benefit the effective governance and curbing of the bribery.
