| The construction project contract’s dentification in nature is very important to grasp the contract relation and clarify the main responsibility of the contract.There are many long-term contract relationship in construction project contract,and the relationships between all kinds of contract are a variety of similar.If the nature of each kind of contract relationship isn’t identified,it will not clear the responsibility of the parties bearing and will lead the parties in construction contract dispute greatly on responsibility.The construction contract law enacted early,so the law lag,and fuzziness has been exposed which has not fully effective adjustment of the existing types of contractual relations and the practice of identification and so on.While contract disputes and the legal blank of the contractual relations has been existed for a long time,so the development of the construction industry is extremely unfavorable.The Research of current rarely touches on the identification of various types of contractual relationships,and therefore,it is very important to identify the nature of the contract after the contract disputes.The article from a real case of the parties for the third people between the contractor and the contractual relationship between the dispute as the base.First of all,through the concept of several existing main contract relations,characteristic analysis to compare the main differences between various types of contract relationship,and then combined with the citation case.In this paper,analysising another phenomenon of the construction industry and the long-term existence of the housing mortgage behavior to determine the final quotation case the parties bear responsibility.Which also puts forward some thinking and suggestions to improve the identification of construction project contract and the nature of the datio in solutum system,in order to resolve such disputes. |
