Research On The Functions Of Chinese Courts From The Perspective Of Bankruptcy Law

Functions of the court include the power and functions of the court.According to the provisions of Constitution of the People's Republic of China and Organic Law of the People's Courts of the People's Republic of China,the primary function of the Chinese court is to exercise the judicial power to judge the disputes.With the rapid development of society,social contradictions become diversified and complicated,frequent social deviant behavior affect the stability of social order and Chinese economy,under this background,many social contradictions are resolved through judicial act.Functions of Chinese court have been expanded in China judicial practice.The court not only exercise the judicial power,but also exercise the power of judicial interpretation,administrative power and executive power.The court play political functions and economic functions through the exercise of the power.In this paper,we choose the bankruptcy reorganization procedure as an example to study the Chinese functions of the court.We analysis the political and economic function of the court and explore the reasons and rationality of the expansion of court functions,finally puts forward several suggestions on the reform of the court.
