Study On The Legal Issues Of Police Interrogation

Police Interrogation is a kind of action that the suspect on the spot or back to the public office for questioning and checking.It is a measure of police in the public se-curity administration in daily management.If the interrogate is not used properly,it will cause the abuse of public power,which is bad to and maintaining social stability.Therefore,the relevant standards on the interrogation should be developed properly,can help to highlight its social effect.Relevant laws and regulations about interrogation in our country mainly exists in the People ’s Republic of China People’s police law Article 9.However,current police law focus on social aging,has been suspected to heavy effect and light procedures.Procedural justice is necessary.The improper procedures will cause social injustice,sometimes even cause the consequences of violations of human rights.The deficiency of interrogation mainly reflects in the start standards,implement-ing subject,implementation object,duration,depth,range,legal remedy and so on,which is beyond the limits of public tolerance.Improve police interrogation system is conducive to improve the relevant provisions of the protection of human rights,and the importance of procedural justice is more prominent,which is of great significance.This paper consists of four parts.The first part is an overview of the basic con-cepts,basic characteristics and legal natures.The second part is the deficiency of in-terrogation,analyzes the problems and causes in the start standards from three aspects.The third part is the problem of implementation in interrogating,points out the defects from four aspects,in the legal and procedural at present in our country.The fourth part analyzes the present practical defects from the aspects of perfecting the legal norms,strengthening the external supervision,adding legal remedies and so on.
