Research On The Legal System Of Bridge Bank

Cross-bank banking system is a very effective tool in the rapid disposal of banking crisis,it plays an important role in maintaining financial stability,maintaining the underlying financial services of the failed banks and sharing the losses of the failed banks.Now the global banking crisis disposal system is increasingly perfect,the financial developed countries to quickly strengthen their own crisis disposal legislation,and China’s banking crisis disposal mechanism is not yet sound,the disposal of institutional alternative disposal is not complete,so I chose the bridge banking system as Research,with a view to the establishment of China’s banking risk disposal system.On the basis of the status quo of the domestic and international banking crisis disposal legislation and the existing research results,this paper discusses the development course of the bridge bank and its position in the crisis disposal of commercial banks.Secondly,On the basis of relevant legislation,combs the framework of the legal system of the bridge,including the nature,function,operation and dissolution of the bridge.Then I detailed the international organizations and countries on the bridge bank’s relevant legal provisions,as well as the establishment of cross-bank banking system in China inspiration.On the basis of the above,the author puts forward some suggestions on how to construct the legal system of China’s cross-bank banks,including the establishment of the bridge,the legal status,the operation and so on,and the measures to be set up to implement the bridge system.
