The Study On Measurement Of Penalty In Cases About Women Killing Her Abusive Partner

The measurement of penalty to women who killed her husband is a kind of judicial activities to the women who has been suffering from family violence for a long time and take extreme way suddenly in silence to kill assaulters with destroying the whole family.Before the enact of Anti-domestic Violence Law,Women who have been abused by their husbands can't be protected adequately by then laws actually,so their avenging behaviors of killing or hurting husbands are all extreme actions under helpless feeling or spirit rush.This paper focuses on this kind of women and discusses measurement of penalty to try to reach an agreement about this issue in the frame of law.This paper is divided into three parts.The first part,after analyzing present situation about these cases and comparing measurement of penalty on this issue at home and abroad,forwardviewpoint.It is actions saving abused women should follow sentencing standardization reform as well as find basis to support measurement of penalty.The second part,after analyzing reasons of these cases and comparing difference on domestic measurement of penalty by cases,points out problems on statistics and measurement of penalty about these cases.The third partgiving advice to perfect measurement of penalty,which is using probation as soon as possible but not death penalty to deal with this kind of cases,and fulfill light punishment gradually.Then we can reach an agreement about the standardized measurement of penalty.
