Research On The Legal Nature Of The Waterborne Boat Tourism Civil Legal Issues

With the development of social economy,the prosperity of tourism has promoted the rapidly development of waterborne tourism industry.There are a variety of forms of water tourism,this paper mainly analyzes the legal issues of water tourism from the perspective of waterborne boat tourism.Nowadays,whether the amount or the type of coastal and inland waterborne boat tourism has a more tremendous growth and change than days before reform and opening-up in China.But with the development of aquatic tourism industry,all kinds of relevant disputes have multiplied in recent years,involving some rather complicated legal problems.In order to regulate a better development of waterborne boat tourism industry,maintain the legitimate interests of passengers,practitioners and other related person in this field,as well as reduce some unnecessary disputes,the necessity of doing some research on these legal problems are vital important.As an emerging tourism industry,the academic research about waterborne boat tourism'legal problems are still not enough.And then mainly analyzed the legal application of water boat tourism and the civil compensation of the accident,and finally made some legislative suggestions according to our legislative situation.Firstly,this paper introduced the development course,concept and characteristics of water boat tourism.Secondly,by comparing the similarities and differences between the water boat tourism contract and the cruise ship and the sea passenger transport contract,it figured out the legal nature of the tourism contract of water boat.And it studied the legal application of tourism contract for water boat.Thirdly,it discussed the subject and the scope of civil compensation liability after the accident occurred in the execution of tourism contract of water boat.Lastly,based on the above analyses,according to the huge operational risk of water boat tourism and the serious civil compensation liability issues,it advised that the restrictions of civil compensation liability and compulsory liability insurance system should be established.
