The Study On Personal Non-property Rights In Russia | Posted on:2018-01-03 | Degree:Master | Type:Thesis | Country:China | Candidate:W T Yan | Full Text:PDF | GTID:2336330515486996 | Subject:Law | Abstract/Summary: | PDF Full Text Request | With the requirement of individual rights and personality equality in thousands of years of human history,Personality Rights have stepped into the spotlight in recent centuries.the demand pushes forward the modern personality development and gradually complete.In the course of the development of personality rights,Russia has its own unique development model which affect the China’s legal system deeply.Since the 20th century,China began using the Soviet law as a reference to build her own system and the effects reached its peak in the 1950’s.Our scholars have done a lot of research about the western developed countries’ law with few study of Russian personality.The purpose of writing this essay is trying to find some useful experience in exploring personal non-property rights(personality rights)in China by researching the historical developments and changes in personality rights of the Russia,the Soviet Union and after the Soviet Union disintegration.Russia in 2008 promulgated the "Russian Civil Code" which gave a valuable example to analyze the personal and non-property rights laws and regulations in China.This paper basis on the following structure.The first chapter introduces the definition and development of personality right from the whole.After the summary of the concept of human and personality,then introduced how the concept of personality rights occurred.In the last part of the first chapter,it discusses the current situation of the development of personality rights in various countries and the problems from the development of science and technology and economy should be considered.The second chapter of the paper mainly analyzes the development of Russian personal and non-property rights through the process of the development of Russian human and non-property rights.It mainly introduces the provisions on the right of citizens’ freedom in the period of the Russian.Though the law in this period reflected the respect for personality,but not the law for protecting personality rights.The Soviet period mainly through the introduction of the 1922 "Soviet Civil Code" and the 1964 "Soviet Civil Code" to introduce the personal and non-property rights.Finally,the contents of the personal and non-property rights after the disintegration of the Soviet Union were introduced which take into account of the background of the political,economic and international environment.The third chapter discusses the definition of the right of non-property of Russian and introduces the provisions of the Russian Civil Code in 2008 on the non-property rights.The fourth chapter of the thesis introduces the important role of the Russian non-property right to the Chinese legal system construction.The Russia’s law deepest impact period on China’s is in the Soviet Union.We should dialectically recognize that this effect has a positive side also has a negative side.Although the Soviet Union disintegrated,but this effect is not entirely replaceable.The most far-reaching and most positive influence is making Chinese citizens pay more attention to individual rights and the concept of equality of personality.The fifth part of the thesis is a short summary of the development process of the Russian non-property rights. | Keywords/Search Tags: | Russian personal non--property rights, personality, personality right, "Russian Civil Code" | PDF Full Text Request | Related items |
