The Study On Copyright Torts Cognizance Of Video Aggregate Platform

In recent years,video aggregate platforms appear and provide one-stop service for users.However,the deep link technology of the video aggregate platforms is a divisive issue.There are two opposite viewpoints on video aggregate platforms'tort issues in theacademic circles,server standard and users standard.In the judicial practice,courts make application of law confused by using different standard.The primary cause of this is different understandings on "providing works".This paper analyses the video aggregate platform and support substance present standard to solve this issue by using cases in the judicial practice.This paper considers substance present standard is more reasonable than server standard and users standard,it also can protect linked video websites and promote video aggregate platform to develop healthily.This thesis consists of three sections:The first part analyses the video aggregate platforms' model from behavior subject?behavior way?object of the action,introduce the legal issues.The second part introduce the cognized standards,discuss the defects of the sever standard?users standard?effective technical measures?anti-unfair competition law.The third part understand providing works again,advocate substance present standard is reasonable,discuss it is reasonable by the purpose of the copyright and balancing the interests.This paper suggest the Supreme People's Court proclaim judicial interpretation and the guide case.Expand the Right of Communication through Information Network to cover the deep link of the video aggregate platform in legislative layer.
