Judicial Determination Problem On Research Of Crime Of Abusing Person Under Guardianship And Caregiver

Since the Ninth Amendment of Criminal Law is implemented,the crime of abuse type in the Criminal Law has been added with another new charge.It embodies the criminal law's special protection towards the special social groups.It is necessary for the application to analyze the specific issues related to the constitution and the concrete determination of the crime of abusing the person under guardianship and caregiver.It requires theoretical definition and analysis to understand the subject of crime,object of crime,the abuse and the implication of "the duty of guardianship and caregiver".It should give misgivings for the problems of Criminal pattern.It also requires interpretation for the differences between this crime and others.There are three sections in my article except the Introduction and Conclusion.First part is analysis on constitutive requirements of the crime of abusing the people under guardianship and caregiver.Second part is analyzing and explaining criminal pattern of the crime of abusing the person under guardianship and caregiver by using typical case and theory of criminal law.Last part is about the difference between the crime of abusing the person under guardianship and caregiver and other charges.
