Research On The Governance Mechanism Of The Rural Joint Stock Cooperation Organization From The Perspective Of The Law

Governance mechanism reform of joint-stock cooperative organizations in rural areas as an important content of rural reform,to the prosperity and development of the rural areas,the peasants' rights and interests,especially the increase of property rights,to the stability of China's agriculture has important significance.This article selects an important dimension of joint-stock cooperative organizations in rural areas,governance mechanism.From the legal angle,This paper applies the methods of research,such as the methods of literature,questionnaire,and field visit,and uses analytical tools such as logical thinking and case analysis.After the reform of the village collective economic organization,the governance mechanisms operate perfectly in detail.Due to the accelerating urbanization process of the country,the original organization governance mechanism is not matching with the economic development level.The governance mechanism reform of joint-stock cooperative organizations in rural areas appears in this situation arises at the historic moment.After reviewing the literatures at home and abroad,the author analyzes the views of experts,scholars.The basic theory of the governance mechanism of the rural shareholding cooperation organization is expounded.This paper analyzes the relevant concepts such as the rural joint-stock cooperation organization and the governance mechanism,and analyzes the pattern,process and development trend of the reform.In the governance mechanism of the study,we divided into two directions respectively,internal governance,external governance.On the basis of the author of participating in the research,with cases of SPSS,EXCLE analysis results of the data,we get relevant conclusions.we analyze the type to equity,registration,profit distribution,the registration,voting mechanisms to provide the legal analysis.In the external governance,The emphasis of the authors includes the business unity,financial management,leadership organizations' setup,the function division.,the relationship coordination between organizations,villagers' committee,government and the related subject.Through the front part of the narrative,we have a more clear understanding of the cooperation organization of the rural governance mechanism.For the difficulty and the bottleneck of the organization's governance mechanism,we have representational and better understanding.After detailing the problems of internal and external governance,the author read a lot of laws andregulations,and got an overview of the typical laws and regulations in China and abroad.In the laws and regulations,including both the case law of Anglo-American law system,and the civil law of statute law,on the choice of subject,both the companies,agricultural cooperatives,and the rural joint stock cooperative system organization are the main bodies,we strive to put the optional mode of joint-stock cooperative organizations in rural areas into a bag.Due to the particularity of organization and novelty,external governance embodies the public opinion in China more,foreign laws and regulations in this part is of little significance,so the author focuses on analyzing the relevant legal provisions of the internal governance.At last,the article puts forward the legislative ideas about organizational governance mechanism,on the basis of the necessity of the legislation and the legislative form,the writer puts forward some major problems which the law needs to clear.The author according to the division of internal and external governance mechanism puts forward the corresponding legislative proposals and thinking.Th newborns can obtain equity,the land cannot be incorporated into the folding quantitative range,we cancel the collective share settings and establish a unified equity trading platform,to clear the village collective assets.Above all of these,the author puts forward its own views,in order to arouse the attention of relevant departments and accelerate the development of legislative work of the organizational governance mechanism,to the improvement of the rural joint-stock cooperative organizations governance mechanisms.
