| Since the 18th national congress of the communist party was met,guiding by the thought of scientific development,the construction of rules on the party has achieved a series of accomplishment,on the background of ruling and being in power by law.Ruling law in the party has been the focus of the academic circles on the basis of rules of law on the party.To perfect the construction of ruling law in the party for the scientific、democratic and law-based system on the party and improve the ability of scientific、democratic and law-based governance for the modernization of national governance capacity and autonomization of the social governance,we have to plan the obligation and rights of the party members,specially for the obligation.The nature and purpose of the Chinese communist party has also showed that the members have to perform the obligations by the Party rules.This article is divided into four chapters to study the party member obligations based on the basic theory,obligations’ history and specification investigation,the comparative study of the outside party member obligations,the obligations’ generalization.This paper combines relevant throries such as the basic theory,history and present situation of investigation,with practices such as the obligations’ generalization.Through the combination of theory and practice,from the angle of the party of the rule of law,The concept and characteristica of the party member obligations has been clear.The first chapter is the basic theory.With the definition of the educational circles,the author give a definition of the party members’ obligations,analysis the features and point out that the most important feature is the political nature.The author also explore the obligations’ relationship with the party members’ rights and citizens’ obligations.The second chapter is the obligations’ history and specification investigation.Based on the important source and historical evolution of the party member obligations,the history of obligations was investigated.The author analyzed the nature,status,function of the party constitution;The party member’s historical evolution can be divided into three stages:revolutionary war stage,stage of socialist construction,reform and opening up.Based on the classification of the party member obligations and the implementation of the party member obligations-the payment of the dues.the status of the party member obligations are analyzed.The third chapter is the comparative study of the outside party member obligations.Firstly,the author collected some foreign party constitutions,which have been divided into two kinds:the outside communist party’s constitution and the others.For the communist party’s constitution,the author has chosen for the ruling party in the country of Vietnam,Cuba’s communist party constitution,and also selected the communist party of Japan,Brazil,the United States,which have greater influence on its parliament in the capitalist countries.For others,the author selected the democratic and the republican party constitution in the United States,Britain’s Labour party constitution,Singapore people’s action party constitution,the anc party constitution.To different rules for party members and obligations outside the party constitution as the basis,the author analyzes the national party in the party member obligations subject,the classification of the party member obligations and the practice of different duties of party members,for providing reference for improving and perfecting to our.The fourth chapter is the party member obligations regulation research.The author anlysis the principle and standard of generalization. |
