Research Of Legal Countermeasures On The Prevention Of Political Risks About China’s Overseas Investment

With the promotion of the "going out" strategy, China’s overseas investment grows quickly, and become one of the major exporters of capital. With different domestic investment, foreign investment enterprises to develop processes often face a more complicated situation, face more risks. Among these risks, commercial risks arising from their own vulnerability management, decision-making errors caused, but also because of the risk of non-commercial and social situation in the host country policy changes initiated. With the expansion of the scale of overseas investment, a variety of commercial and non-commercial risks are increasing, this is also an objective requires us to make greater efforts to deal with the risk in the investment, the development of more detailed measures.Based on analysis of overseas investment risks and general philosophy of risk prevention, present situation and characteristics of China’s overseas investment, it analyzes the types and causes of the major political risks of China’s overseas investment, the aspects of domestic law and international law elaborated the current system of overseas investment and risk prevention problems, finally puts forward some measures on overseas investment risk prevention.At the current situation, China can take the following measures to deal with overseas investment risks:Firstly, to strengthen domestic legislation and improve overseas investment insurance system in line with national conditions, and the establishment of a unified and efficient overseas investment risk early warning mechanism; Secondly, to strengthen the protection of overseas investment international cooperation, and constantly develop and improve investment-related bilateral agreements and multilateral conventions, overseas investment to build a sound risk prevention and relief of the international legal system. I hope to provide some references for the healthy development of Chinese enterprises overseas investment by overseas investment risk analysis and discussion of issues related to this article.
