With the rapid development of the Internet technology, online shopping has been becoming increasingly. As the most widespread transaction mode in today’s non-traditional transaction mode, there has been a large number of emerging legal issues in the network transaction as well as the increasing number of the Internet dispute, Furthermore, the Consumer’s rights is encountering more severe challenges. Looking from the laws of the developed countries, other regions and the international agreements, they have established the consumer’s right to regret or provided cooling-off period for a long period in the direct marketing sector, door to door sales、remote transaction、E-commerce and so on, in order to protect Consumer’s right better. It has great significance of introducing a new system of regret rights and furthering the interests of consumer protection in terms of improving the consumer protection system. However, this article will argue that it is inadequate and this system needs the specific provisions to ensure smooth implementing of this right. On the basis of sorting out the current researching and learning from the experience advanced legislation aboard and connecting with the practical situation of China, this article presents the scope and the new system of regret rights and its prerequisite of application and puts forward suggestions on the specific provisions of application、the prohibition of abusing the regret right and the implementation of the safeguard mechanism.
