In order to solve the problem caused by the framed links,this paper focus on the legal regulation of framed links with seven parts.The first part is the introduction,which mainly introduces the research status of the framed links interiorly and abroad,the significance of the legal regulation of the framed links and the research methods used in this article.The second part leads to the theme of this paper from the phenomenon of frequent dispute caused by framed links,namely,whether it needs to take legal measures to regulate the framed links,the manner in which the framed links to regulate and how to regulate.The third part defines the concept of research object by compared with embedded links and deep links,in order to ensure that the conclusions discussed in the paper can be applied accurately.Since the framed links has produced a lot of cases in practice,the fourth part mainly introduces the four different judgment mode of framed links currently,including: take using framed links legally,framed links constitutes unfair competition,the site who set up link and the linked site constitute joint tort and identified a framed link behavior constitute an infringement of the right of information network dissemination.The fifth part of the article demonstrates the necessity of framed link regulation through the argument to the view of legal framed links and the damage caused by the free development of the framed links.As well as the damage of the framed links is mainly reflected on the right of linked sites who get access to enforce the information network dissemination rights and the right of the copyright owners,so it should be the copyright law to regulate the framed links.The sixth part first disseminate of the category of the right of information network dissemination by analyzing the origin meaning,and clear the point of view that framed links can fall into the scope of the protection of the right of information network dissemination.Then this part introduce the four elements constituted infringement of the right of information network dissemination,which mainly suggests the standard should be taked to determine whether the framed links constitute a tort.This part mainly solves the problem that framed links should be regulated by the right of information network dissemination,and how to regulate it.The seventh part is the conclusion,which summarizes the viewpoint of this paper.
