Research On The System Of Tainted Witness In Bribery Crime In China

in China’s judicial practice,there "re investigation of bribery,bribery cases do light" pattern,but of course is not spared on bribery for the prosecution of crime with the judicial organs,therefore,our country should construct the system of tainted witnesses in the bribery crime,to standardize the investigation including bribery,stain the undertaker.Tainted witness system is the general term of a series of systems,such as the scope of application,operation mode,object,procedure and guarantee of the Stain Witness.The tainted witness system is the product of the mutual compromise between the civil rights and the criminal prosecution function which is against the forced self evidence,and the theory basis is the principle of interest balance.Based on the analysis of legitimacy,necessity and feasibility of introducing the system of tainted witness bribery crime in our country on the attempt from the applicable scope,object,mode of operation,the relevant judicial procedure,fixed method,tainted witness immunity of tainted witness,witness,witness protection should be punished in eight aspects the bribery crime in China in the construction of tainted witness system.This paper is divided into three parts,the first part is mainly on the analysis of the present situation and the appropriate people for bribery in the judicial practice of our country and the existing problems;the second part is mainly on the stain witness system are introduced,and analyzed the necessity and feasibility of construction and is when the stain witness system in our country of the crime of bribery the third part is mainly about;from eight aspects,try to construct the system of tainted witnesses in the bribery crime in China in.
