| With the rapid development of social economy,science and technology and culture.people’s cultural living standard rises rapidly.In addition,all kinds of new and fast things constantly emerge.As a result,the trational consumption idea can’t satisfy the needs of the masses.So with the further popularzation of network,online shopping has become an important way of shopping.In order to meet the demands of life,people purchase goods through the intermet.Meanwhlie,the consumers need to sign an agreement with pperator through the computer information network system to form,change and eliminate the rights and obligations with the purpose of purchasing goods or receiving services.China Internet network information center(CNNIC)issued《the 37 th china Internet network development state statistic report》.According to its latest statistic,by December 2015,the number of Chinese Internet users has grown to 688 million,39.51million of whom were new Internet users,increasing by 6.1%.The rate of Internet penetration is 50.3%,increasing by 2.4%compared with the same period in 2014.Online shopping presents the fast growth momentum.Under the influence of network marketing and the changes of consumption idea,many businessmen have to break the single business model to explove new network channels to search for the new growth point.Accoraing to the report,the traditional businessmen have come to realize that the traditional business model is greatly influenced by the network shopping penetration and will virtually be replaced by network sales channels with the aid of the innovation in the Internet business management pattern.Nowadays,the litigation caused by network shopping is increasing.However,different courts for such cases is not completely consistent.Some courts judge that the website fails to perform the contract while others don’t.This is because the congnizance of the contract of the network shopping in the practice is different.Along with these problems,I attempt to research some legal issues in details which are related to network shopping contract offer、invitation、promise and the timing of the contract.Based on the concept and characteristic,following the traditional contract law,I manage to settle them through deductive reasoning and inductive reasoning,using the research methods of jurispruence the empirical analysis,comparative analysis.What’s more,I propose the idea about perfecting the network shopping cntract. |
