In 1994,the labor law of the People's Republic of China promulgated,on January1,2008,the labor contract law of the People's Republic of China(hereinafter referred to as " labor contract law ")formally implemented,on July 1,2013,labor contract law amendment initiated,these legal documents constitutes the basic framework of China's labor law.The implementation of the labor law,plays an important role in protecting legitimate rights and interests of workers,arousing the enthusiasm of workers,standardizing enterprise human resources management,improving the labor market,and promoting economic and social development.At the same time,it also brings the enterprise human resources management a higher request and a greater challenge.In the process of enterprise actual operation,the management faults and legal risks are still widespread,which triggers labor disputes endlessly.Human resources are the most important resource of enterprises.It is a big issue for enterprises to identify and avoid the risks,which exist in entering into labor contracts,maintaining and terminating labor relationship,in order to make human resources management both reasonable and legitimate,when maximumly development and increase the efficiency of the human resource management.This article will combine my experience of human resources management work in one enterprise,starting with the relationship of labor laws and human resources management,summarize the influence of the labor law to enterprises and the current situation of enterprise human resources management,and then analyze the legal risks existing in each management link.Finally this article will put forward prevention countermeasures in,on the basis of my management experience,make the enterprise to further enhance the level of the management of human resources.
