Research On Criminal Law Regulation About Illegal Private Financing

In recent years, along with the frequent cases of illegal financing, folk financing problems in China have become the focus of more and more scholars. The stability of the financial market plays a vital role in sustainable economic development in China. Therefore, the healthy development of private financing activities ensured by law regulation and guidance is the urgent need to guarantee the normal development of economy. Although, about private financing activities, China has established a regulation system of criminal law, there are still some problems in this system which includs the criminal law, judicial interpretation and accessory criminal law in the context of rapid economic development, so some illegal financing activities with social harm appear. In this paper, the author makes some research on the regulation systemof China's criminal law regulation system of private financing, and puts forward relevant suggestions on how to build and improve to ensure the healthy operation of private financing under the frame of law. The study of the problem is also a continuation of the theory of criminal law, so it has the theoretical meaning and practical significance. This paper covers four parts in the research process:In the first part, the author explains related concepts of private financing and performance. First, the related concept of folk financing and activities are introduced. Then, the causes, as well as the types and characteristics of the private financing activities in China are analyzed. This part is the basis of this paper. Due to so much negative impact of the illegal financing activities on social economy, it is necessary to regulate them by means of criminal law.In the second part, the author ananlyzes the regulation system of China's criminal law regulation system of private financing. First, the composition of China's current private financing regulations of the criminal law system, including four parts: criminal code, subsidiary criminal law, judicial interpretation and other crimes in judicial practice, altoghther seven crimes in four aspects.Then, summarize the characteristics of present criminal law regulation system of private financing.The third part deals with the problems and causes of China's current criminal law regulations of private financing. From the judicial practice in recent years, the measures about China's current criminal law regulation of private financing have yielded some results, but the problems are still prominent.The fourth part is about how to perfect the criminal law regulation system. This part summarizes the above analysis based on the basic situation of our country, puts forward some suggestions from the perspective of complying with the law of economic development and financial activities.
