A Study On Methods For Absconding Suspect Of Economic Offense To Surrender Oneself To Justice

Along with the swift and violent development of market economy, a large number of new pattern industries have appeared, especially financial industry. Network financing platform and investment organizations emerge in endlessly, promoting the rapid expansion of society and upturning the living standard to a new level. Meanwhile, a lot of economic crimes appeared and illegal fund-raising, pyramid scheme, loan fraud and illegal business have raised to the node of high incidence. A large number of economic criminals go abroad with vast sums of money to evade criminal punishment after gaining huge profits, bringing huge economic losses to country and people.As the violent organization of state political power, the public security organ should maintain socialist market economy order, crack down economic crimes and arrest the absconding economic criminals, which is the obligatory responsibility of public security organ. Since the “Hunting Party”, the public security organ has arrested 680 fled economic criminals from 69 countries and regions with a rising trend. While arresting the fled economic criminals, the public security organ should overcome the objective factors of language barrier, uncomfortable climate and unfamiliar territory and more importantly the application problem between domestic law and the national law of residence of the escaped criminal should be taken into consideration. In most cases, when arresting a fled economic criminal, a large number of human and material resources are needed and the judicial coordination with local judicial organ should be done, however, the effect of punishing criminals can not be achieved. Hence, after several attempts, the public security organ have found that they can improve work efficiency and lower the cost of pursuit evasion through applying the admonishment methods for absconding suspect of economic offense to surrender oneself to justice. We think that the proper use of admonishment methods can help public security organ complete the pursuit evasion of economic criminals.The admonishment method for suspect of economic offense to surrender oneself to justice is an important nonviolent method of public security organ; although its criminal coercive force is weaker than other crime fighting means, it can play an important role in the juridical practice due to its unique influence. Compared with other pursuit evasion means, the admonishment has the advantages of low cost and high effectiveness, which is especially obvious in the investigation of long-pending cases and old court cases.The practice has proved that when persuading absconding suspect of economic offense through admonishment method, the policy of “combining punishment with leniency” for absconding suspects of economic offense can be reflected and meanwhile, the handling procedures can be simplified and wasting of resources be reduced and thus it is an efficient and successful pursuit evasion mode. At the present stage, the pursuit evasion in China has no mechanism, and thus we should constantly explore and study this method so as to give full play to its advantages of low cost and high efficiency.
