The Cognizance Of Crime Of Corruption Subjects

Along with the reforming and opening and the establishment of market economy, economic organizations emerge in endlessly, the market subjects diversified increasingly, the subject of duty crime has various forms, but the laws and regulations that about the subject of duty crime which rooted in the planned economy system are lagging and imperfect. But in the study and trial of the duty crime, the cognizance of the subject is very important and critical. As the result of the consistency in the subject of the corruption and bribery crime, this paper focuses on the subject of the corruption, draws lessons from some of the current authoritative scholars' views, combines with relevant cases and the author's work experience, analyzes the essence and characteristics of corruption from the view of the acknowledgment of the subject of the corruption and the controversial situations that about the quasi-state staffs as the subject of the corruption, and discusses the view combined with the party organs at all levels and other special subjects. It is necessary that to clear the subject of the corruption. The author also puts forward some suggestions to improve the laws that about the subject of the corruption and reduce the scope of the subject of the corruption.
