A Study On The Imam Mediation System Of Ningxia Hui Autonomous Region

This paper starts from the present situation of imam mediate dispute resolution mechanism in Ningxia Hui Autonomous Region that combined the realities, find out the problems in the practice of the imam mediation system in Ningxia, then put forward a corresponding solution, by means of the analysis of resolution mechanism with minority characteristics——imam mediation. Imam mediation, as a bold attempt in Ningxia, has practically proved to be socially useful. However, problems still existed in the employment of this system, followings are items that generalized. In the first place, at the legal system level, it reflects two points:1. Imam mediation has no clear legislation orientation.2. The customary law that imams cited gambles with the national law. In the second place, at the Level law enforcement, it reflects three points:1. The law literacy of imam mediators is overall low.2. Problems exist in the mediators and the financial security of mediation organizations.3.There is no reasonable connections between imam mediation and formal judicial mediation. Based on the problems mentioned above, the author throw out the following suggestions:Firstly, at the legal system level, definite the legislation orientation of imam mediation is one aspect, properly handle the relationship between customary law and national law is the other. Secondly, at the Level law enforcement, pay attention to the training of imam mediators to promote their law quality; increase security efforts to imam mediation funds; complete the connections between imam mediation and judicial mediation. Finally, through the study of imam mediate dispute resolution mechanism, find out and settle problems in time, making this mechanism with minority characteristics play its genuine role in solving disputes in the process of building a socialist harmonious society.
