The Research On Legal Regulation Of PAEs’ Patent Abuse

Patent Assertion Entities(PAEs) refers to those who do not manufacture any product, just through licensing or litigatio n for the interests of the company. They are also known as Patent trolls, Patent cockroaches, Patent sharks or non-practicing Entities. The rise of the PAEs phenomenon has important influence to the social and economic, especially their action of prosecution. In the United States, for example, the portion of patent litigation initiated by Patent Assertion Entities soared from 29% to 62% during 2010 to 2012, and the number increased from 731 to 2500. Through the analyzing of PAEs’ origin, classification and operation mode, and through the discussion of the concept of patent abuse, this article try to give out some suggestions on the legal regulation of Patent Assertion Entities in our country.
