Effectiveness Designation Of Substantive Departure From The Construction Contract

The alteration of construction contract is different from the usual sense of the contract. According to the construction project cases, the paper analyzes the substance of the substantial departure from the contract and discuss the validity of the contracts.The article is divided into three chapters. The first chapter summarize the current judicial points and propose the topics are identified and validity on the basis of the substantial departure from the contract.The second chapter analyzes the path of substantial departure from the contract. This chapter is divided into three sections, the first section discuss the scope of the substance of the contract, including the price, schedule, quality and so on. The second section discuss the judging standard of the substantial departure, distinguish the supplement from departure of the contract.The third chapter analyzes the legal effect of different types of substantial departure. For the typical construction project, the filing contract is valid, and any substance departure of filing contract is invalid. The non-typical construction project, which carry out bidding process should apply The Bidding Law, but filling is not the settlement basis standard. The project which is without the bidding should follow the Contract Law of the People’s Republic of China.
