| In order to achieve success of the new round judicial reform, the key point is to consider judicial independence as the principle, to take judge personnel system as the breakthrough point and to shape the professional and elite image of judges. This paper discusses how to allocate specified number of judges from three aspects, such as the theory, empirical science and assumption. Then it states the theoretical foundation of judge personnel system by the principle of judge independence and HCT(Human Capital Theory) and elucidates the standard of establishing the specified number of judges from empirical aspect. This paper confirms the specified number of judges according to the core judging work and determines the amount and rate of supplementary and administrative staff by supplementary work. It also focuses on the computing method and the significance and limitation of methodology. The most important is based on the problem of reality and looks for the balance between the number of cases and judges to play up for judicial reform. |
